  Kansas Officials to visit flooded areas Monday, July 23.

Gov. Kathleen Sebelius expanded the crew of cabinet secretaries and aides who are going to flooded areas of southeast Kansas Monday to see how they can be helpful. We told you about the excursion Wednesday, of course.

  Advancing Excellence Campaign

The Advancing Excellence in America's Nursing Homes campaign is the first national effort to measure quality by setting measurable 'clinical" and "process" goals in eight key quality indicators.  KHCA members are working steadily to build on our track record of quality care through participation in "Advancing Excellence."  As of July 19th, 86 KHCA nursing facilities, 75% of our membership have enrolled in the campaign and are actively working on their quality goals.  Kansas ranks in the top 15 states for percentage of facilities enrolled.

Research Article

Rosalie Kane and co-authors published an article in the Journal of the American Geriatrics Society, Volume 55(6), June 2007 reporting on their study on the effect of, quoting from the abstract, “a small-house nursing home model, THE GREEN HOUSE, on residents’ reported outcomes and quality of care.” Summarizing from the abstract, the authors found that controlling for baseline characteristics, the two-year study showed statistically significant differences in self-reported quality of life measures when compared to the comparison groups. The quality of care measures at a minimum equaled those for the control groups except for change in functional status, which exceeded the nursing home comparison groups.   CMS Issues Civil Money Penalty Tool

The Centers for Medicare & Medicaid Services (CMS) has issued a Civil Money Penalty (CMP) Analytic Tool to state survey agency directors.   The CMS letter provides a CMP analytic tool for Regional Offices (ROs) to use in evaluating the reasonableness of State-recommended CMP amounts to those amounts suggested by the tool.  While use of the tool is not mandatory for States, CMP amounts recommended by States will be periodically compared by CMS to the tool amounts to ensure that the recommended amounts are within a generally acceptable range in order to promote as much national consistency as possible.  This tool is slightly different from the tool that was piloted during the summer of 2006.

The 7/1/07 Final Nursing Facility Medicaid Rates are posted on the KHCA website at www.khca.org under the member’s only section.


Minimum Wage Increase Update
The minimum wage bill was signed by the President the end of May and is set to be implemented in 3 tiers as follows:
  
   $5.85 effective with the 7/1/07 rates
   $6.55 effective with the 7/1/08 rates
   $7.55 effective with the 7/1/09 rates
  
The Kansas Department of Aging reported that it will take them up to 90 days to implement the process and that payments will be retroactive to Providers. KDOA will be requesting information from Providers on any wage increases up to the minimum wage of $5.85 and will implement a pass-through mechanism to account for Providers increased expenses that are not currently recognized in the payment rate.  They intend to use the same procedure that they have used in the past with minimum wage increases.

EDS Update
EDS is looking into claims previously paid in error and recouping the amounts.  If you receive a remittance advice with a claim recouped and you believe it is a valid claim you need to contact your EDS Representative or resolve the issue within 90 days.

Please check the KHCA website at www.khca.org for the latest Life Safety Code / Fire Marshal Product Recalls.  

Kathy Achor recently reported that there has been discussion regarding magnetic locking devices and whether doors in a nursing home can routinely be locked. According to Kathy, CMS has reviewed the Life Safety Code requirements and discussed the issue with their Central Office.
 
At issue is NFPA 101 Life Safety Code, 2000 Edition, Sections 19.2.2.2.4 and 18.2.2.2.4, which states:  “Doors within a required means of egress shall not be equipped with a latch or lock that requires the use of a tool or key from the egress side.”  There is an exception (Exception No. 1) that indicates that “Door-locking arrangements without delayed egress shall be permitted in health care occupancies, or portions of health care occupancies, where the clinical needs of the patients require specialized security measures for their safety, provided that staff can readily unlock such doors at all times.”
 
The nursing home environment is considered to be a home and residents have the right to come and go freely. CMS does not believe all nursing home residents have clinical needs regarding their safety, particularly that would justify restrictions on their egress from various locations of the facility. CMS requires a comprehensive and individualized assessment of each resident’s needs to determine what care and services are necessary to meet his/her highest practicable well-being. It would be a rare occasion to have an entire patient population with clinical needs requiring locked means of egress, since one approach is usually not the right course of action for all residents.
 
The NFPA 101 Life Safety Code, 2000 Edition, Sections 19.2.2.2.4 and 18.2.2.2.4 did not change the determination of clinical need under exception 1. Rather, the language was updated in an effort to broaden the use of the code, not to become more restrictive. It is CMS’s expectation, that during a Life Safety Code survey, K38 will be cited if egress doors on a floor are locked and there is evidence that all cognitively aware residents, staff and visitors do not have access to the method of opening the doors. If staff is not aware of how to open the doors or are unable do so, it is very likely an immediate jeopardy situation. In cases where a health and Life Safety Code survey are done at the same time, we would expect health surveyors to investigate and cite this issue, under resident rights or another appropriate regulation, unless there is evidence that it is not a deficient practice.   
 
CMS Updates: Sliding Glass Windows in Existing Buildings
 
According to Kathy Achor, CMS has decided to allow the use of the exceptions to LSC section 19.3.6.1 to allow a sliding glass window from the corridor to a reception area or office. The open area would have to meet all of the conditions such as sprinkler coverage and smoke detection systems that are required by the code exceptions.
Although this may not be the intent of the Code, we hope that allowing this alternative method of compliance will enhance communication while protecting the privacy of health care information.  The code requirements follow. Please call Kathy with any questions.

  Members Going Greensburg

Wednesday, July 25th, KCAL members will be traveling to Greensburg to serve dinner to the community starting at 5:00pm.  The group will set up cooking at Carriage House of Greensburg.  Any member wishing to participate can contact Bev Blassingame at Rolling Hills Assisted Living, 785-273-2202.  The plan is cook hamburgers and brats for between 400-600 people.  Members have been securing donations but could use more assistance both financial and just "bodies".   Bev is a veteran of planning this type of event in New Orleans.  She has traveled back and forth to New Orleans since Hurricane Katrina and has become a force to be reckoned with in planning this type of fellowship.  Thank you to Bev for all of her hard work!!

  NCAL accomplishments for the Second Quarter

PUBLIC POLICY ADVOCACY

* Following through on a pledge to NCAL, Oregon Sen. Gordon Smith (R) introduced the bipartisan S. 1107 in April. The legislation would eliminate Medicare Part D co-pays for dual eligibles residing in assisted living and other types of residential care facilities.

* NCAL’s advocacy and lobbying efforts resulted in more senators signing onto S. 1107, bringing the total number of co-sponsors to 10 during the quarter.

* NCAL submitted statements urging Congress to pass legislation addressing the Medicare Part D co-pay issue at several congressional committee hearings, including those held by the House Ways and Means Committee health subcommittee, the House Energy and Commerce Committee, the Senate Finance Committee, and Senate Special Committee on Aging. 

* NCAL’s policy and lobbying departments worked to obtain introduction of a companion bill to S. 1107 in the House of Representatives. NCAL coordinated political action committee activities to support introduction of Part D Co-pay bill. NCAL also identified champions in Congress.

* NCAL/AHCA member Gail Clarkson testified before the House Energy and Commerce Committee hearing on Medicare Part D and stressed the need for Congress to act on the co-pay issue.

* NCAL organized a coalition of 36 national organizations representing a broad range of interests to sign onto a letter that was sent to Sen. Smith in support of the passage of Medicare Part D co-pay legislation.

* NCAL members and staff promoted Part D co-pay and Medicaid financing legislation during the 2007 AHCA/NCAL Congressional Briefing.  NCAL staff and NCAL members provided congressional staff with background material on assisted living and educated them about NCAL’s legislative objectives.   

* NCAL continued working to elevate its presence among Washington, D.C. policymakers in a variety of ways.  NCAL lobbied members of Congress on veterans care issues.  NCAL staff attended congressional fundraising events and participated in policy discussions held by groups including the Long Term Care Discussion Group, the American Enterprise Institute, and the Alliance for Health Reform. These meetings are attended by congressional and executive branch staff and as well as a variety of organizations with an interest in long term care issues.  NCAL also met with senior Senate Finance Committee staff as part of its participation in a coalition working on Medicaid issues.

* NCAL’s Board of Directors once again achieved 100 percent participation in AHCA PAC. A campaign was organized and executed asking Board members to reach out to NCAL State Leaders through letters and phone calls urging them all to contribute to the PAC. 

* NCAL identified key members of Congress for PAC campaign contributions and began identifying association members and state affiliate staff to cultivate relationships with these members of Congress and their staffs.

* NCAL worked with Congressional staff to help shape a variety of proposed bills that would affect the assisted living profession and residents if passed.  Bills cover a range of issues such as pharmacy services available to assisted living residents under Medicare Part D, a pilot program to fund assisted living services for veterans with traumatic brain injuries, a national clearinghouse to help reduce falls among the elderly, and a grant program to fund the retrofitting of assisted living facilities needing to upgrade fire safety systems including sprinklers.

* NCAL submitted formal comments to the Agency for Healthcare Research and Quality about a study to prevent falls in assisted living. NCAL’s letter recommended wider data collection to reflect more accurate findings on a national basis. NCAL also recommended elimination of the term “prevent” because prevention implies a fall would never occur again in a facility after the study’s evidence-based protocols were implemented.

* NCAL worked with Rep. Michael Arcuri’s (D-NY) staff to re-draft legislation to include assisted living. Rep. Arcuri’s bill would establish grants for retrofitting assisted living facilities with fire safety equipment, including sprinklers. NCAL also sent a letter to Rep. Arcuri thanking him for introducing the legislation. 

* NCAL participated in a meeting convened by the American Institute of Architects, the organization responsible for issuing building and design guidelines for health care facilities. This meeting launches a multi-year process to begin updating its design guidelines book.

* NCAL joined with AHCA to develop long term care Medicaid reform principles, and post acute care and long term care reform proposals, to meet the needs of an aging population.     

* NCAL increased its participation in the National Fire Protection Association by actively participating in the NFPA’s annual meeting.

* NCAL staff met with Veterans Administration (VA) officials in May to establish a relationship and begin educating members about the availability of VA Aid & Attendance (A&A) benefits. A&A benefits can provide certain veterans who served in war time as well as surviving spouses and dependents funds to pay for assisted living. NCAL Focus published an article in June about how an NCAL member provider is helping veteran residents and surviving spouses apply for the benefit. The article was used by the Center for Excellence in Assisted Living’s Advisory Council to explain the benefit to other assisted living stakeholders.

QUALITY IMPROVEMENT AND HUMAN RESOURCES

* NCAL staff actively participated in the Center for Excellence in Assisted Living meetings and projects.   Shelley Sabo of NCAL’s staff was appointed to head CEAL’s Advisory Committee. 

* NCAL developed “Guiding Principles for Quality in Assisted Living” and “Guiding Principles for Providing Information to Consumers.” Both documents were approved by the Board.

* NCAL’s Quality Committee and the NCAL Board voted to support the Alzheimer’s Association’s practice guidelines on end-of-life care for residents with dementia. The guidelines will be released in late summer.

* NCAL obtained the Consumer Consortium for Assisted Living participating with NCAL’s Consumer Relations Committee to work on Resident and Family Council guidance.

* NCAL continued to educate members through NCALconnections and Focus about Fair Labor Standards Act compliance and the Equal Employment Opportunity Act.

MEMBER SERVICES

* NCAL developed and published the 2007 National Assisted Living Week (NALW) Planning Guide and Product Catalog. The catalog was mailed to members of NCAL and promoted on the NALW Web site and NCAL’s Web site.  “Legacies of Love” is the 2007 NALW theme.

* NCAL launched its sales program for National Assisted Living Week products.

* NCAL finalized its agenda for NCAL Day on October 7, 2007.  As part of this new event, NCAL added a hands-on technology session that will feature various vendors.  In addition, NCAL secured Anthony Cirillo of Fast Forward Consulting to discuss “Turning Customers into Crusaders. NCAL also produced and distributed a flyer promoting NCAL Day.

* NCAL worked with AHCA to devise a user-friendly association Web site and improve Web site content management.

* NCAL held quarterly NCAL State Leader conference calls, monthly calls with state affiliates and monthly calls with NCAL’s Executive Committee.

* NCAL staff delivered presentations at the following NCAL state affiliate conventions: Nebraska; Colorado, Ohio; and, New Jersey.

* NCAL informed the Board and membership through an E-Alert about the Service Employee International Union’s new effort targeting assisted living.

 GOVERNANCE

* NCAL initiated its 2007/2008NCAL officers and At-Large Member election process.

* NCAL’s Board approved a plan for membership growth and business development in 2008 and 2009.

* NCAL’s Board approved a motion to propose amendments to the NCAL Bylaws creating a succession process for officers who resign or leave office.

* NCAL membership grew by more than 3,100 beds during this quarter.
