RUG-IV delay repeal and therapy caps exceptions process extension sent to the President

Congress passed legislation addressing the RUG-IV delay and the therapy caps exceptions process. The Medicare and Medicaid Extenders Act of 2010 (H.R. 4994) was passed by both the House and the Senate earlier this week and has been sent to the President for his signature.

In addition to repealing the RUG-IV implementation delay and extending the therapy caps exceptions process until December 31, 2011, the bill also halts a 25% cut in the Medicare physician fee schedule. Two Medicaid programs also were extended until December 31, 2011,specifically the Qualifying Individual Program and the Transitional Medical Assistance Program. A summary of the bill is available here.

KHCA/kcal thanks everyone who contacted their Member of Congress about RUG-IV and therapy caps because these grassroots contacts strongly contributed to this success. We will be monitoring the Centers for Medicare and Medicaid Services’ implementation efforts and will keep providers informed.

Veterans and Their Spouses are Targets of Scam

KHCA has been asked by the Kansas Office of the Kansas Securities Commissioner to alert members about an investment scam that is occurring in Kansas adult care homes. Individuals present themselves as financial planners/advisers to veterans residing in nursing homes.  They charge a fee of several hundred to several thousand dollars to provide advice on benefits that is otherwise available free of charge.

Any legitimate advisor on veteran benefits or investments should be able to produce an authorization letter from the U.S. Department of Veterans Affairs. The Kansas Office of Securities Commissioner can also verify that a salesperson is licensed to sell securities and the investment has been registered for sale in Kansas and whether any disciplinary actions have been taken against the salesperson or company.
